Terms and Conditions
The purpose of these Terms and Conditions is to set forth the terms and conditions under which Casio Computer Co., Ltd.(hereinafter referred to as "Casio") will use Your posted episodes, images and captions (hereinafter referred to as "Posts") related to Casio's products for Casio's own promotion. If You agree to give Casio permission to use Your Posts (“Permission”), please confirm and agree to all of the following terms and conditions and reply to the direct message sent from Casio's official Instagram account stating that You give Your Permission to Casio. By replying with such Permission, You will be deemed to have agreed to be bound by these terms and conditions.
If You are a minor, please reply and give Your Permission only if Your legal parental or guardian agrees to these Terms and Conditions.
I. You shall agree to grant Casio an irrevocable, nonexclusive, worldwide, royalty-free and sublicensable license to use, reproduce, modify, adapt, edit, publish, exhibit, distribute and display the Posts in any and all media (including but not limited to Casio’s website [https://www.casio.com/XXXX]) or distribution methods. You shall not exercise Your moral rights concerning the use of the Posts by Casio.
II. You represent and warrant to Casio that:
(1) You have the necessary and sufficient legitimate rights to grant the use of the Posts in accordance with these Terms and Conditions;
(2) the Posts will not infringe or may not infringe any intellectual property right, including copyright, property right and other rights of any individual, organization, group, etc.;
(3) the Posts will not contain, or may not contain, contents that breach laws, or contents contrary to public order and morals; and
(4) You are not, and will not be a person who falls under any of the following: (i) an Anti-Social Force;(ii) a member of an Anti-Social Force currently or in the last five years; or (iii) a person who has any socially criticized relationship with the Anti-Social Force. "Anti-Social Forces" means an organized crime group, a corporate racketeer, and any other similar organization.
III. The publication or non-publication, the period of publication, the media in which the Posts will be published, and other methods of use of the Posts shall be determined at the sole discretion of Casio.
IV. Casio may use the Posts, at its sole discretion, in advertising and promotional materials, promotional e-mails or other ways.
V. Casio may omit, remove or delete any indication of authorship (including but not limited to credit notation or Your account name) in the use of the Posts.
VI. Casio may use the Posts, after removing personally identifiable information, as reference material for product development or marketing data.
VII. Casio shall not be liable for any damages or losses incurred by You in connection with, relating to or arising from Casio's use of the Posts, unless such damage or loss is caused by Casio's gross negligence.

This Privacy Notice ("Privacy Notice") describes the method through which we will process and protect information relating to an identified or identifiable natural person ("Personal Data") collected through the entry form and processed for the purposes of the use of Your Posts by Casio ("Publication").

3. Processing of Personal Data (categories of Personal Data)
Casio will collect and process the following Personal Data about You:
i) Your Instagram account username .
4. Processing Purposes
Casio will process and use the Personal Data of You for the following purposes:
① To manage the Publication, including communication with You; and
② To respond to various inquiries from You.
5. Legal justifications for the processing of Personal Data
Privacy law requires that any processing of Personal Data must have a legal justification. We will process Your Personal Data on the grounds of explicit consent (Art. 6(1)(a) GDPR) of You to the processing of Your Personal Data. Alternatively, we will process Your Personal Data where the processing is necessary for the performance of a contract (Art. 6(1)(b) GDPR). We may also process Personal Data on the basis of any other legal ground, such as compliance with a legal obligation or a court order(Art. 6(1)(c) GDPR), or legitimate interest, in particular, to address any queries from You or to detect and prevent any possible fraud (Art. 6 (1)(f) GDPR).
The withdrawal or revocation of Your consent shall not affect the lawfulness of any processing performed on the basis of explicit consent prior to such withdrawal or revocation. Following such withdrawal or revocation, that Your Personal Data may still be processed if there is a legal basis for such processing relevant to compliance with a contractual obligation.

6. Data transfers and recipients and legal justification for such transfers
We will not disclose or transfer Your Personal Data to any third parties except in the following cases:
① When we have received the consent of You in advance.
② When there is a request for disclosure of information from a judicial, administrative, or similar organization in accordance with applicable laws and regulations and we transfer the data on the basis of Art. 6(1)(c) GDPR.
We have implemented appropriate safeguards to ensure that the transfer of Your Personal Data from the European Union (EU) or EEA to a third country outside of the EU or EEA in which the Personal Data will be processed, including in the event that our third party service provider is located in such third country, complies with all applicable data protection requirements (i.e., adequacy decisions, binding corporate rules or standard contractual clauses including supplementary measures). Upon Your request, we will provide that You with a copy of these appropriate safeguards, provided that we process or have processed that Your Personal Data in third countries. If there is no sufficient legal basis for a data transfer from the EU or EEA to a third country, we may transfer the Personal Data on the basis of voluntary consent obtained from You to transfer in that individual case for a specific purpose.
7. Implementation of security measurements
Your Personal Data will be stored by us and/or our service providers which are located or have relevant operations outside of the EEA (namely, Japan ). In order to ensure adequate security and to properly manage Your Personal Data, we have implemented appropriate technical and organizational security measures in accordance with our prescribed privacy policy (https://world.casio.com/privacy/), including the establishment of Personal Data protection rules, conducting trainings for our employees and other appropriate organizational, physical and technical security measures. Any onward transfer is subject to appropriate onward transfer requirements as required by applicable law. 8. Storage period
We will store Your Personal Data in accordance with the GDPR and applicable data protection laws, and only to the extent necessary to achieve the purposes for which the Personal Data was processed. When we no longer have a need to process the Personal Data, such Personal Data will be erased from our systems and/or records and if necessary steps will be taken to anonymize the Personal Data so that the data subject can no longer be identified from the Personal Data. However, we will keep Your information where it is necessary: (i) to comply with legal or regulatory obligations to which we are subject;and/or (ii) with regard to a judicial action.

Under applicable data protection laws (e.g., the GDPR), You may have the following rights:

*1: You have the right to obtain confirmation from us as to whether or not Personal Data concerning You is being processed, and, where that is the case, to request access to the Personal Data. The information that may be accessed includes – inter alia – the purposes of the processing, the categories of Personal Data concerned, and the recipients or categories of recipients to whom the Personal Data have been or will be disclosed. However, this is not an absolute right and the interests of other individuals may restrict Your right of access.
*2: For further copies requested by You, we may charge a reasonable fee based on administrative costs.
*3: You have the right to correct or update any Personal Data about them that is inaccurate or incomplete.
*4: Under certain circumstances, You have the right to request from us the erasure of Personal Data concerning You and we may be obliged to erase such Personal Data.
*5: Under certain circumstances, You have the right to request that we restrict the processing of Your Personal Data. In such a case, the relevant data will be marked and will only be processed by us for certain limited purposes.
*6: Under certain circumstances, You have the right to receive, in a structured, commonly used and machine-readable format, the Personal Data concerning You which You provided to us, and the right to transmit such data to another entity and we will not interfere.
*7 Where we are processing Your Personal Data on the grounds of legitimate interests pursued by us or a third party, You have the right to object at any time on grounds relating to his or her particular situation. This applies particularly where You are a child. We will stop processing the Your data unless we demonstrate compelling legitimate grounds on which to continue the processing which overrides Your interests, rights and freedoms or if it is for the purpose of the establishment, issuing or defense of legal claims.
