PRIVACY NOTICE

Casio Computer Co., Ltd. (“Casio”, “we”, “us” or “our”) takes the protection of your personal information extremely seriously. This Privacy Notice (“Privacy Notice”) describes how Casio processes and protects the Personal Information (as defined below) collected, used, and disclosed (collectively, “processed”) when using our robotic pet product(s), Moflin, (“Product”) and the application software, MofLife, connected to the Product (“App”). “Personal Information” means any information that can allow an individual to be identified directly or indirectly.

This Privacy Notice consists of a “Summary Notice” (see below at section A.) and a “Detailed Notice” (see below at section B.)

A. Summary Notice

Scope of applicability

This Privacy Notice exclusively applies to the processing of your Personal Information when using our App. This Privacy Notice does not apply to the processing of your Personal Information when creating and using a membership service called CASIO ID (“CASIO ID”), the user account that allows you to centrally store and manage master data and functions as your access key across various offerings, solely and/or other apps we provide. Such processing is governed by other privacy policies, so when using CASIO ID with the App, the privacy notice for CASIO ID (https://auth.casio-intl.com/casio_contents/terms/index.html) applies to you additionally.

Please read the following carefully to understand how we will process your Personal Information collected via your use of the App.

Categories of Personal Information we Collect

We may collect the following categories of Personal Information when you use our App: (i) your CASIO ID and the data registered with it; (ii) profile data you register with the App; (iii) device information, including device identifier, model name, OS version, and settings [FJ1.1][N1.2][f1.3][N1.4](such as privacy and push notification preferences) for the mobile device on which the App is installed or from which you access the services (together with the Product, collectively, “Devices”), as well as the date and time of your usage and access; (iv) information about the Product connected to your Devices (such as Bluetooth address, serial number, and network settings) and data collected through the Product’s sensors, including usage status; and (v) any other information you provide to us through forms or other interactions.

Purposes for Processing your Personal Information

We process your Personal Information for the following purposes: (i) providing the functions of the App; (ii) conducting statistical analyses to develop and improve our products and services; (iii) responding to your inquiries and providing customer support; and (iv) sending you information about our products and services that may be of interest to you, by email or push notification.

Sharing of Personal Information

We use third-party service providers to provide services and products on our behalf and we will share your Personal Information with them for the provision of the services and products.

We may also share your Personal Information with governmental authorities, courts, external advisors, and similar third parties that are public bodies as required or permitted by applicable laws.

Cross-border transfer of Personal Information

We and our service providers may store or process your Personal Information in jurisdictions outside of your province or territory of residence, or outside of Canada (including Japan, Ireland, and the US). While your Personal Information is in a foreign jurisdiction, it is subject to the local laws of that country. These laws may allow foreign courts, law enforcement, or national security authorities to access your Personal Information through valid legal requests. We ensure that any transfers of Personal Information are protected by contractual safeguards designed to maintain a level of protection comparable to our own standards in Canada.

Security Measures

We maintain appropriate organizational, physical, and technical security measures to protect your Personal Information, including establishing internal policies, training our employees, and implementing safeguards against unauthorized access, use, or disclosure.

Retention of your Personal Information

We only keep your Personal Information for as long as necessary to fulfill the purposes for which it was collected, or to meet our legal, regulatory, or reporting obligations. Our retention periods vary based on the type of information and the nature of our relationship with you. Once your Personal Information is no longer required, we securely destroy it or anonymize it so that it can no longer directly or indirectly identify you.

Your Privacy Rights

You have certain rights with respect to your Personal Information, including the right to request access to your Personal Information, to request correction of your Personal Information and the right to withdraw your consent to the processing of your Personal Information.

Children’s Privacy 

You may only use the App if you are 13 years of age or older (14 in Quebec). If you have not yet reached the age of majority in your province or territory of residence but meet the applicable minimum age requirement (a “Minor”), we may request your parent or legal guardian’s consent for you to use this App. If we learn that we have mistakenly or unintentionally collected Personal Information from a child below the applicable minimum age without appropriate consent, we will delete it.[FJ2.1][N2.2][f2.3][N2.4]

Changes of the Privacy Notice

This Privacy Notice is subject to change. You will be notified adequately of any material changes via in-app notification and/or email to your registered email address accordingly. 

B. Detailed Notice

We are delighted about your interest in our App. Your privacy is important to us. Hereafter we provide you with detailed information on dealing with your personal information on this App.

This Detailed Notice applies to information you provide to us or that we collect automatically when you access or use our App.

This Privacy Notice does not apply to the processing of your Personal Information using CASIO ID, information we collect when you visit or use our websites or otherwise, such as when you communicate with us through email, text, or other electronic means. Such processing is governed by other privacy policies, so when using CASIO ID with this App, the privacy notice for CASIO ID (https://auth.casio-intl.com/casio_contents/terms/index.html) applies to you additionally. For information regarding how we collect and use information when you visit or use our websites, including web-based pages accessible through our App, please refer to our respective website privacy notice.

1. Categories of Personal Information we Collect

We may collect and process the following categories of Personal Information about you:

(i) CASIO ID Data: We collect and process your CASIO ID and the information registered with it, including your name and email address (“CASIO ID Data”). This information is required to log in to the App with your CASIO ID and is the only information transmitted to the App from your CASIO ID account.

(ii) Profile Data: We collect and process the profile information you register with the App, including your birth year, gender, nickname, and any other profile data you choose to provide (“Profile Data”).

(iii) Device Data: When you use the App, we collect and process information about your Devices, including: (a) device identifier, model name, and OS version; (b) Bluetooth address, serial number, and network settings; (c) your privacy and push notification preferences; and (d) the date and time of your usage and access (“Device Data”).

(iv) Product Data: We collect and process data from the Product’s sensors, including data on how often the Product was touched, turned upside down, shaken, or spoken to, voice data derived from sound tone and manner, and data related to the Product’s behaviour (“Product Data”).

(v) Form Data: We collect and process any other information you provide to us through forms or other interactions (“Form Data”).

2. Purposes for Processing your Personal Information

We process your Personal Information for the following purposes:

(i) Performance Purposes: We use CASIO ID Data, Profile Data, Product Data, Device Data, and Form Data to: (i) authenticate you when you use the App with your CASIO ID; (ii) operate the App and provide you with its features, including activity log features; and (iii) provide customer support and fulfill services in connection with the App.

(ii) Quality Purposes: We use CASIO ID Data, Profile Data, Product Data, and Form Data to: (i) monitor and maintain the performance of the App and Product; (ii) conduct user analyses for statistical, marketing, or other purposes to develop and improve our products and services[FJ3.1][N3.2][f3.3][N3.4]; and (iii) provide customer support.

(iii) Service Development Purposes: We use CASIO ID Data, Profile Data, and Product Data to: (i) improve and develop our products and services, (ii) predict demand to provide enhanced user experiences for current and future offerings, and (iii) develop our advertising and marketing strategies.

(iv) Contact Purposes: We use CASIO ID Data, Profile Data, Product Data, Device Data, and Form Data: (i) to respond to your inquiries, (ii) provide customer support, and (iii) address security and fraud prevention matters.

3. Sharing of Personal Information 

We may share your Personal Information with the following categories of recipients, to the extent necessary for the purposes described in this Privacy Notice:

(i) Third parties: We may share your Personal Information with governmental agencies, regulators, courts, and government authorities as required or permitted by applicable law, or with external advisors (e.g., lawyers, accountants, auditors). We may also share your Personal Information to potential partners in the event of a merger, acquisition, or sale of business assets.

(ii) Service providers: We engage third-party service providers to support our business operations and the operation of the App, including cloud hosting providers, authentication infrastructure vendors, repairment and maintenance service providers.

4. Cross-Border Transfers of Personal Information

To provide our services, we and our service providers may store or process your Personal Information in jurisdictions outside of your province or territory of residence, or outside of Canada (including Japan, Ireland, and the US). While your Personal Information is in a foreign jurisdiction, it is subject to the local laws of that country. These laws may allow foreign courts, law enforcement, or national security authorities to access your Personal Information through valid legal requests.

We ensure that any transfers of Personal Information are protected by contractual safeguards designed to maintain a level of protection comparable to our own standards. 5. Security Measures

We maintain appropriate organizational, physical, and technical security measures to protect your Personal Information, including establishing internal policies, training our employees, and implementing safeguards against unauthorized access, use, or disclosure. We also limit access to your Personal Information to employees, agents, contractors, and other third parties who have a business need to know. They will only process your Personal Information on our instructions and are subject to a duty of confidentiality.

6. Retention of your Personal Information

We only keep your Personal Information for as long as necessary to fulfill the purposes for which it was collected, or to meet our legal, regulatory, or reporting obligations. Our retention periods vary based on the type of information and the nature of our relationship with you.

Once your Personal Information is no longer required, we securely destroy it or anonymize it so that it can no longer directly or indirectly identify you. However, we may need to retain your Personal Information to comply with legal or regulatory obligations, or in connection with a judicial action, in which case it may be stored until the end of such action (including any appeal periods) and will then be deleted or archived as permitted by applicable law.

7. Your Privacy Rights

You have the following rights with respect to your Personal Information, subject to limited exceptions set out in applicable law:

(i) Right of access: You have the right to ask us about our processing of your Personal Information, including about the categories of persons who have access to your Personal Information within our organization and the applicable retention period. You can also request access to Personal Information that we hold about you. Depending on the laws applicable in the region in which you reside, you may also have the right to ask us to provide your Personal Information to you in a structured, commonly used technological format, or to a third party upon your request. We may charge a minimal fee to cover the cost of responding to your request.

(ii) Right to correction: You have the right to ask us to correct any Personal Information that you demonstrate to be incorrect or outdated and to complete any information that you demonstrate to be incomplete.

(iii) Right to withdraw consent: You may withdraw your consent to our processing of your Personal Information to the extent permitted by law and our contractual obligations. However, if you withdraw your consent, you may no longer be able to use the App or benefit from our services.

8. Google Analytics[FJ4.1][N4.2][f4.3][N4.4]

We may use third-party analysis tools that use cookies or identifiers for mobile devices (including similar technologies) when obtaining information from you in accordance with this Notice. For this purpose, we may provide Personal Information to the provider of the third-party analysis tools in compliance with laws applicable in the region in which you reside. This information is handled in accordance with the privacy policy of the provider of the third-party analysis tools. Except in the case of the existence of any technical or fundamental difficulty, you can opt out of providing Personal Information to the provider of these analysis tools via the method offered by us or the provider of the third-party analysis tools (including the following method).

9. Children’s Privacy

11. Changes to the Privacy Notice

This Privacy Notice may require an update from time to time – e.g., due to the implementation of new technologies or the introduction of new services or features. We reserve the right to change or supplement this Privacy Notice at any time. You will be notified of any material changes via in-app notification and/or email to your registered email address accordingly. Further, you will be notified adequately through further relevant Privacy Notice (e.g. for specific purposes) in case such is not covered by this Privacy Notice.
